A Delaware Judge has ruled against warrantless GPS tracking and threw out evidence that was found as a result of illegal search. The DEA placed a GPS device on a suspect's car and tracked his movements for 20 days before stopping his car en route to a suspected drug deal.
Unless there are special circumstances, "the warrantless placement of a GPS device to track a suspect 24 hours a day constitutes an unlawful search," Judge Jurden wrote in her ruling.
